Definition

What Is a Model Release?

A binding agreement between photographer and model — the model grants defined usage rights to their likeness.

  • Type of use (print, online, social media)
  • Scope (editing, transfer to third parties)
  • Duration and region
  • Compensation (money, images or both)

The contract is mandatory especially for commercial use (advertising, agencies, stock).

Legal Foundations

Right to one's own image (German KUG)

§ 22 KUG: distribution / display only with consent. The exceptions in § 23 (contemporary history, gatherings) are narrow — for hobby and commercial use you need a Model Release.

Copyright of the photographer

You hold the copyright in the photograph — the model owns the rights to their likeness. The contract transfers the license to that likeness so you can publish.

Minors

Consent from all legal guardians; from around age 14 the minor's consent is often required as well. Check ID in case of doubt. Include a clause confirming guardianship.

Key Clauses

Parties
Full names, addresses, all legal guardians for minors, date and location of the shoot.
Usage rights
Be precise: what (advertising, stock, editing), where (DE/EU/worldwide), how long — no vague "all rights".
Compensation
Paid: amount and payment deadline. TFP: number and delivery deadline of images, in detail.
Credits
Clarify naming for photographer and model — a common source of dispute.
GDPR
Separate consent under Art. 6 (1) (a), information obligations under Art. 13 — see the GDPR guide.

For nude shoots: confirm age of majority via ID, explicit permission for erotic contexts and exclude degrading use.

Property

Property Release

Owner's consent for private interiors, recognizable architecture, art on private property, unique animals, museums and stadiums with photo policies.

Freedom of panorama (§ 59 UrhG) covers buildings seen from public ways — not interiors or drone perspectives over private property.

  • Also: trademarks/logos, copyrighted art in the image, graffiti
  • Rules differ internationally (e.g. the illuminated Eiffel Tower at night)

A Property Release alone is often not enough — check the "nested rights" at a location.

FAQ & Common Mistakes

  • Verbal agreements without proof
  • Vague "all rights on the internet"

Does payment cover all usage rights?
No. Without explicit rights transfer in the contract, the purpose-transfer doctrine applies — only the purpose recognizable at the time of the contract.
Do I need a contract for TFP?
Yes — even without money you need written usage rights and GDPR consent.
Is freedom of panorama enough for interior shots?
No — § 59 UrhG does not cover private interiors; a Property Release is required.
Are the PDF templates GDPR-compliant?
They contain basic clauses — adapt them to your purpose and cross-check with the GDPR guide.
